Alimony
Alimony is financial support that one former spouse pays to the other after a divorce. It is similar to child support in that it is an ongoing financial responsibility of one spouse after the dissolution of the marriage, but is treated differently both in determination and from a tax standpoint.
Alimony is just one of the many aspects of a divorce decree and the multi-faceted agreement that must be reached upon termination of the union. Division of property, custody of children, and other issues must be resolved as well.
Determining Alimony
Alimony is determined based on a variety of factors, including: length of marriage, relative income, age, future earnings prospects, and health. In many states, a marriage that has lasted longer than 10 years is a good candidate for permanent alimony, which has no end date. In this way it is unlike child support, which will end when the child turns 18.
Our West Palm Beach alimony attorneys have a wealth of experience helping our clients with alimony-related issues. We may be able to help you if your case involves:
- Temporary Alimony
- Permanent Alimony
- Modifying Alimony
Alimony is considered income for the person receiving it and can be considered a deduction for the person paying it. This carries certain tax implications; child support does not have these tax considerations because it is not considered income, nor can it be deducted.
