Divorce and the Military
Serving in the military can be very stressful on a marriage because of the inherent danger and the time spent away from home. Unfortunately, this can lead to divorce for some military personnel, and it is important to understand that there are some slightly different stipulations and regulations for the divorce of military personnel.
Child support payments and alimony are slightly different when determining amounts for military personnel. This is because some of the income figures and compensation may be more complicated because of the military’s payment system and the regulations governing the actions of service members. Disposable income must be considered for retired service members, which is not always the same, because of the pensions, as traditional private retirement accounts.
Additionally, military pensions are divisible as an asset in a divorce. They are subject to slightly different rules, though, than are other private retirement funds because of the government’s involvement in the pensions.
Because the military personnel spend so much time overseas and the government is involved in the soldiers’ affairs, there may be some different regulations about where the couple goes to court. It is important to have legal advice that is familiar with the specific regulations in a given court jurisdiction.
