Do It Yourself Divorce
Most divorcing couples have a very difficult time agreeing on the various issues that have to be reconciled when going into a divorce. They will often disagree about settlement amounts, support payments, asset allocation, custody rights, and other issues. In many cases, it can be necessary to hire a mediator or a divorce lawyer to help resolve some of these disputes.
Some people, although a relatively small segment of divorcing couples, are in a position for a “do it yourself” divorce. The reason that only a few couples would be eligible for this kind of divorce is because it requires agreement on every issue without the intervention of a mediator or lawyer.
The couples must agree on the following issues to qualify for a do it yourself divorce:
- Satisfaction that both sides have fully disclosed all assets and income
- Relatively simple assets to divide
- Children must be cared for in custody, visitation, and support agreements
- Both sides must agree that the settlement is equitable and reasonable
The two people have to agree on essentially everything. If this is the case, then there are some cheap books and websites that will offer the necessary forms and guidelines to walk you through the process. This is much, much cheaper than hiring a mediator or a lawyer, but most couples do not agree on all of these issues.
