Settling Custody Disputes
Unfortunately, divorcing spouses do not always agree on who should have custody of the child or children upon dissolution of the marriage. Although custody is just one of the many issues that must be resolved for the divorce to happen, it can often be the most emotional and stressful.
When parents are unable to agree on custody of the child, the court must intervene and make a decision. This can be very frustrating for the parent who does not get custody of the child, but in any event, the court tries to make a decision in the best interest of the child.
The court’s effort to make a decision in the best interest of the child takes into account various factors. These include:
- Physical and mental health of parents
- Which parent has been the primary caretaker
- Any history of family abuse or violence
- The child’s age, and, in some cases, the child’s wishes
It can be extremely frustrating for the parents to be told by a court which one of them gets custody of their child, but in cases where the parents simply are unable to agree, a decision must be made.
