What Are Visitation Rights?
Visitation rights guarantee the non-custodial parent the right to visit the children after divorce. Visitation rights are not necessarily available in every case, usually being denied when the parent in question has a history of child abuse or substance abuse. These rights can be established by the courts or through a separation agreement by the divorcing spouses themselves. Commonly, visitation rights include parts of vacation breaks, alternating major holidays (one spouse gets Thanksgiving, the other gets Christmas), alternate weekends, and sometimes one weekday.
