A separation agreement is a document drawn up before a divorce goes to trial and agreed to by both sides which determines the division of property and assets, custody of children, and support payments. Not all divorces involve separation agreements; often, if neither side can come to an agreement, the court has to make these decisions for them. However, because a separation agreement is mutually agreed upon, it has a much higher chance of being adhered to.
