An at-fault divorce is one in which one of the spouses is responsible for the end of the marriage. Oftentimes, this means that one spouse was engaging in an extra-marital affair, or domestic abuse, or other actions that caused the marriage to be unhealthy for the other party. Although most states no longer require fault in a divorce proceeding, the assignment of fault can often affect things like alimony payments, custody of children, and the division of property.
